Patient Safety Program Bill

On August 5, 2008, Governor Paterson signed into law his landmark legislation that will greatly improve patient safety, enhance the State's authority in medical investigations and help to prevent future infection control violations.

What does the bill do?

This bill seeks to improve patient safety in three important ways. First, it seeks to ensure that appropriate steps are taken against physicians who engage in professional misconduct while ensuring appropriate due process for physicians. Second, the bill helps patients become better informed consumers about the quality of the physicians who treat them by making information about particular professional misconduct proceedings available to consumers. Third, the bill will help to reduce the incidence of infectious diseases by improving infection control education and practices.

When does the law become effective?

  • Section 15 of the bill became effective September 1, 2008.
  • Sections 1-14, Sections 16-19, Section 21 and Sections 23-26 take effect on November 3, 2008 (90 days after enactment of the legislation).
  • Sections 20 and 22 take effect on January 1, 2009.
